Simplisio Ai Service Terms
These Service Terms govern your use of specific features within the Services. Capitalized terms not defined here will have the meanings in the Terms of Use or other agreement you have with us governing your use of the Services (“Agreement”). If there is a conflict between these Service Terms and your Agreement, these Service Terms will control regarding the specific features they address. For purposes of these Terms, “Content” has the meaning given in the Agreement.
1. Beta Services
This section governs your use of services or features that Simplisio Ai offers on an alpha, preview, early access, or beta basis (“Beta Services”). Beta Services are offered “as-is” to allow testing and evaluation.
Simplisio Ai makes no representations or warranties for Beta Services, including any warranty that Beta Services will be generally available, uninterrupted or error-free, or that Content will be secure or not lost or damaged. Beta Services are excluded from any indemnification obligations Simplisio Ai may have to you under the Agreement. Except to the extent prohibited by law, Simplisio Ai expressly disclaims all warranties for Beta Services, including any implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, non-infringement, or quiet enjoyment, and any warranties arising out of any course of dealing or usage of trade.
2. Simplisio Ai Business Accounts
(a) Administrators. Simplisio Ai Business Accounts are managed by End Users with administrative privileges (“Administrators”). Administrators may be able to add, remove and suspend End Users’ access to the organization’s workspace. Customers are responsible for obtaining and maintaining all necessary consents from their End Users to allow Administrators to take these actions and to allow Simplisio Ai to deliver the Services accordingly.
(b) Output. Output generated via Simplisio Ai Business Accounts is subject to the intellectual property considerations, disclaimers, and limitations outlined in the main Agreement. Simplisio Ai does not provide a separate intellectual property infringement indemnity for Output specific to Business Accounts.
3. Code Generation
Output containing computer code generated via our Services may be subject to third-party licenses, including, without limitation, open source licenses. You are responsible for complying with such licenses.
4. Custom Agents / Personalized Assistants
Users may be able to create and share access to their own customized versions of Simplisio Ai services
- For Builders of Custom Chatbots/Assistants:
- (a) Content. The information or content you upload to or include with your Custom Chatbots/Assistants (e.g., name, instructions, description) (“Custom Content”) is your Content. As between you and Simplisio Ai, you are solely responsible for your Custom Content, associated configurations, and any external services (“Actions” – see below) you connect, as well as any Output based on these. You must ensure your Custom Chatbots/Assistants complies with the Agreement and our Usage Policies.
- (b) Distribution. By sharing your Custom Chatbots/Assistants with others, you grant a nonexclusive, worldwide, irrevocable, royalty-free license: (i) to Simplisio Ai to use, test, store, copy, translate, display, modify, distribute, promote, and make available your Custom Chatbots/Assistants (including Custom Content) to operate and improve the Service; and (ii) to users of your Custom Chatbots/Assistants to use Output derived from your Custom Content according to these Terms. You must ensure information published about your Custom Chatbots/Assistants is accurate and not misleading.
- (c) Actions. Any external API, website, or service that interacts with a Custom Chatbots/Assistants (“Action”) is subject to the terms in Section 6 below (“External Integrations / Actions”) You are responsible for ensuring any Action included complies with those terms.
- (d) Removal. Simplisio Ai may reject or remove any Custom Chatbots/Assistants at any time for any reason without notice, such as for legal or security reasons or violations of our terms.
- For Users of Custom Chatbots/Assistants:
- (a) Third-Party Agents. Except where Simplisio Ai is identified as the builder, Custom Chatbots/Assistantss are created by other users and may rely on content or third-party applications not controlled by Simplisio Ai. Use of “Custom Chatbots/Assistants” does not imply Simplisio Ai endorsement. Only use Custom Chatbots/Assistantss that you trust.
- (b) Abuse Reporting. Report Custom Chatbots/Assistants violating our Usage Policies using our reporting feature or by contacting us.
- (c) Actions. Custom Chatbots/Assistantss may allow interaction with Actions, subject to Section 6 below.
- (d) Changes and Removal. Simplisio Ai and creators can remove Custom Chatbots/Assistantss at any time without notice.
5. Image and Video Capabilities
Our Services may allow you to provide images and videos as Input (“Visual Input”).
You may not use Visual Input or Output to identify a person without their explicit consent, nor to solicit or infer private or sensitive information. You may not use these capabilities to reproduce anyone’s likeness without express consent and necessary rights, particularly anyone under 18.
By choosing to share an image or video publicly on the Services, you grant Simplisio Ai the right to reproduce, distribute, modify, display, and perform it for the purpose of operating and promoting the Services where it is shared.
6. External Integrations / Actions
(a) Overview. Certain features (“Integrations” or “Actions”) may allow you to instruct our Services to interact with third-party applications or websites (“External Applications”). These Integrations are typically enabled by you and provided by third-party developers. You are solely responsible for any instructions you give or actions you take via these Integrations. Use Integrations only with External Applications you trust and whose terms and privacy policies you have reviewed. Simplisio Ai may review, refuse, or remove Integrations/External Applications from its platform but has no obligation to do so. You use Integrations at your own risk and may encounter content you find offensive or objectionable via External Applications.
(b) Operation and Content. When you use an Integration, the Services may send relevant parts of your Content and context information (like country/region) (“Integration Data”) to the External Application as instructed by you or the Integration. By using the Integration, you authorize Simplisio Ai to send Integration Data to the applicable External Application, which handles it according to its own terms and privacy policy. Simplisio Ai is not responsible for Integration Data once sent to an External Application (unless owned by Simplisio Ai). Information retrieved from the External Application via the Integration and included in the Service’s Output is subject to the External Application’s terms and is not typically owned by you or Simplisio Ai.
7. Voice Conversations
Our Services may include a feature allowing voice input and spoken output (“Voice Feature”). The audio output generated by the Voice Feature is intended for personal, non-commercial use only and may not be distributed as standalone audio files. Any rights in Output assigned to you under the Agreement may not extend to the specific audio recording generated by the Voice Feature.
8. Medical Use
Our Services are not medical devices and are not intended for use in the diagnosis, cure, mitigation, treatment, or prevention of any disease or 1 health condition. You are responsible for complying with all applicable laws and regulations (like HIPAA, if applicable) for any use of our Services in a medical or healthcare context.
